Constitution and By-Laws
ARTICLE I
name and object
Section 1. Name
This organization shall be known as the “Kentucky Chapter, International Association of Arson Investigators, Inc.” and is hereinafter referred to as the “Kentucky Chapter.” The name of the Association may be used by any member, provided such use is in conformance with policies established and approved by the Board of Directors.
Section 2. Object
The objectives and purposes of the Kentucky Chapter shall be:
- To unite for mutual benefit those public officials and private persons engaged in the control of arson and kindred crimes.
- To provide for the exchange of technical information and developments.
- To cooperate with other law enforcement agencies and associations to further fire investigation and the suppression of crime.
- To encourage high professional standards of conduct among members and to continually strive to eliminate all factors that interfere with the administration of justice.
- To foster the advancement of the fire investigation profession through the promotion and facilitation of research, and the sponsorship of training, education, and professional development.
Section 3. Professional Conduct
All members of the Association shall comply with the Code of Ethics, which sets forth the personal and professional conduct expected of members.
The Association shall not be operated for profit, and its funds may not be used to align with any political body, group, or person to advance the candidacy of any individual for public office. The Kentucky Chapter may support legislation relating to arson and kindred crimes.
ARTICLE II
Membership
Section 1. Active Membership
Any representative of good moral character involved with government or a government agency, and/or any representative of a business or industrial concern who is actively engaged in some phase of fire and arson investigation or the administration of justice at the time of application shall be eligible for membership, provided the applicant is not less than eighteen (18) years of age.
Active members shall have the right to vote on Association business and to hold office.
Section 2. Associate Membership
Persons who do not qualify for active membership may become associate members. Associate members shall have the privileges of active members, except the right to vote or hold office.
Section 3. Student Membership
Student members may pay a reduced membership fee as established by the Board of Directors. A student is defined as an individual not currently employed in a paid position in the fire investigation field and who is enrolled full-time in an accredited post-secondary institution pursuing a degree in fire science, fire investigation, administration of justice, or a related field of study.
Student members shall not have the right to vote or hold office.
Section 4. Life Membership
The Association may bestow Life Membership for Distinguished Service upon qualified members who meet the following requirements:
- The individual must be, or have been, an active member of the Kentucky Chapter.
- The individual must have been an active member in good standing for a minimum of ten (10) years.
- The individual must have rendered distinctive service to the Kentucky Chapter through participation on committees or activities for a minimum of five (5) years.
No more than two (2) life memberships may be awarded in any calendar year. Life members shall have all the rights and privileges of an active member without payment of dues.
Section 5. Corporate Members
Corporations and public agencies whose services or mission support fire safety, prevention, investigation, prosecution, or public safety may become Corporate Members. Corporate Members shall not have the right to vote on Association business.
Section 6. Personal Qualifications
To be eligible for membership, applicants must meet the following qualifications:
- Be of good moral character and reputation.
- Conduct business consistent with the Kentucky IAAI Code of Ethics.
- Be associated with employers and associates consistent with the Code of Ethics.
No person shall be eligible for membership if they are affiliated with organizations whose purposes are inconsistent with those of the Association.
Section 7. Retired Membership
Retired Membership is available to former Active Members in good standing who are no longer working in fire and arson investigation or the administration of justice, including those permanently disabled due to job-related injuries. Retired members shall not have the right to vote or hold office.
Section 8. Membership Approval
Applications for membership shall be reviewed and approved by the Board of Directors in accordance with membership qualifications.
Section 9. Termination
Membership may be terminated by voluntary withdrawal, failure to pay dues, or action of the Board of Directors.
Section 10. Sanctions
The Board of Directors may impose sanctions, including probation, suspension, or termination, for violations such as falsification of information, felony convictions, ethical breaches, or misuse of professional credentials.
Section 11. Reinstatement
Former members may be reinstated at the discretion of the Board of Directors, subject to payment of any outstanding financial obligations unless waived for good cause.
ARTICLE III
Elections, Terms, and Offices
Elections, Terms, and Offices
The officers of the Kentucky Chapter shall include a President, Vice President, Secretary, Treasurer, and Sergeant at Arms. The Board of Directors shall consist of the officers, the Immediate Past President, and seven (7) elected members.
Officers serve one-year terms. Directors serve staggered three-year terms. Vacancies may be filled by the President until the next annual meeting. Removal from office requires a two-thirds (2/3) vote of the Board of Directors.
ARTICLE IV
Government
The government of the Kentucky Chapter shall be vested in the Board of Directors, which shall have full authority to manage the affairs of the Chapter. The duties of the President, Vice President, Secretary, Treasurer, and Sergeant at Arms are defined within this Article.
ARTICLE V
Meetings
Annual, special, and Board of Directors meetings may be held in person or by approved electronic communication technologies and shall be conducted in accordance with Robert’s Rules of Order, as revised.
ARTICLE VI
General
All official meetings of the Kentucky Chapter shall be conducted in a professional manner and solely for the purpose of furthering the objectives of the International Association of Arson Investigators.
ARTICLE VII
Finance
Membership dues shall be established by vote of the membership. Failure to pay dues within sixty (60) days of the due date shall result in forfeiture of membership. The Finance Committee shall conduct audits of the Chapter’s financial records.
ARTICLE VIII
Amendment
These By-Laws may be amended by a two-thirds (2/3) vote of the members present at any regular or special meeting.
